Welcome to Birding.Store. These Terms and Conditions govern your use of the Birding.Store website and the purchase of products through it.
Birding.Store is operated by Plumas Imprevistas Unipessoal LDA and is part of The Green Pot Network initiative. By using this website or placing an order, you agree to these Terms and Conditions.

2. Scope
These Terms and Conditions apply to:
your access to and use of the Birding.Store website; and
any purchase of products made directly through Birding.Store.
Certain products or links on this website may direct you to third-party websites or sellers. In those cases, additional third-party terms may apply, as explained below.
3. Eligibility and Use of the Website
By using this website, you confirm that:
you are at least 18 years old, or you are using the website under the supervision of a parent or legal guardian;
the information you provide is accurate and complete; and
you will not use this website for any unlawful, fraudulent, abusive, or harmful purpose.
You agree not to interfere with the normal operation of the website, attempt unauthorized access, upload malicious code, or misuse any part of the site.
4. Products and Availability
We make reasonable efforts to describe our products as accurately as possible. However:
product images are for illustration purposes and may differ slightly from the final product;
colors, texture, scale, and appearance may vary depending on your screen, print process, materials, and manufacturing methods;
product availability may change at any time; and
we reserve the right to correct errors, update information, or remove products without prior notice.
All products are subject to availability. If a product becomes unavailable after an order is placed, we may contact you to offer an alternative, delay fulfilment, or issue a refund.
5. Nature of Our Product Model
Birding.Store may offer products through different models, including:
print-on-demand products, manufactured only after an order is placed;
products fulfilled by third-party suppliers or partners; and
affiliate-linked products, where a purchase is completed on a third-party website.
This means we do not always directly manufacture, stock, or physically handle all products shown on our website.
For products sold directly by Birding.Store, the contract is between you and Plumas Imprevistas Unipessoal LDA.
For affiliate-linked products, your purchase is completed on a third-party website and your contract is with that third-party seller, not with Birding.Store. In those cases:
the third party is responsible for product descriptions, fulfilment, shipping, returns, warranties, and customer service related to that order; and
Birding.Store may receive an affiliate commission if you complete the purchase.
We try to clearly identify when a product or link leads to a third-party seller.
6. Prices, Taxes, and Shipping Costs
All prices displayed on Birding.Store are shown in USD.
Unless otherwise stated:
prices include VAT where legally applicable; and
shipping costs, customs duties, local taxes, or other additional charges are shown separately during checkout or are the responsibility of the customer where stated.
We reserve the right to change prices at any time before an order is placed. Price changes will not affect orders already accepted.
If an obvious pricing error occurs, we reserve the right to cancel the affected order and refund any amount paid.
7. Orders and Contract Formation
When you place an order through Birding.Store, you are making an offer to purchase the selected product(s).
Your order is only accepted when we send you an order confirmation or otherwise confirm that the order has been accepted. We may refuse or cancel an order, including in cases involving:
product unavailability;
payment failure;
suspected fraud or misuse;
incorrect pricing or product information; or
shipping restrictions or legal limitations.
If we cancel an order after payment has been received, we will refund the amount paid using the original payment method, unless otherwise agreed.
8. Payment
We accept the payment methods shown at checkout.
By placing an order, you confirm that:
the payment information provided is valid and accurate; and
you are authorized to use the selected payment method.
Payments are processed through third-party payment providers. We do not store full payment card details unless explicitly stated.
9. Delivery and Fulfilment
Delivery times shown on the website are estimates only unless expressly stated otherwise.
Because some products are made to order or fulfilled by third-party partners:
production times may vary;
shipping times may vary by destination, carrier, and season;
delays may occur due to customs, logistics issues, supplier constraints, or events outside our control.
We are responsible for direct orders until the goods are delivered to you, unless you arrange your own independent carrier where the law allows otherwise.
Please make sure that your delivery details are correct. We are not responsible for delays or losses resulting from incorrect address information provided by you.
10. Right of Withdrawal and Returns
If you are a consumer in the European Union and you purchase a product directly from Birding.Store through a distance contract, you generally have the right to withdraw from the purchase within 14 days without giving any reason.
For goods, the withdrawal period expires 14 days after the day on which you, or a third party indicated by you other than the carrier, acquire physical possession of the goods.

You may use the model withdrawal form at the end of these Terms and Conditions, but you can also notify us by any clear written statement.
If your withdrawal relates to a product sold directly by Birding.Store, we will provide you with the applicable return instructions and the correct return address for that product, which may be our address or the address of an authorised fulfilment or print partner.
For affiliate-linked products purchased from third-party sellers, the applicable seller is responsible for returns, withdrawals, refunds, and customer service.
10.1 Effects of Withdrawal
If you validly withdraw from a purchase, we will reimburse you for the payments received for the returned product, including the standard cost of delivery where required by applicable law. We will make the reimbursement using the same payment method used for the original transaction, unless we agree otherwise.
We may withhold reimbursement until we have received the goods back or until you provide proof that you have sent them back, whichever is earlier.
You must send the goods back without undue delay and no later than 14 days after notifying us of withdrawal.
10.2 Return Costs
Unless otherwise stated by law or in a specific product policy, you are responsible for the direct cost of returning goods when exercising the right of withdrawal.
If a product cannot normally be returned by post due to size or nature, the estimated return cost will be communicated before purchase where required.
10.3 Condition of Returned Goods
You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
10.4 Exceptions to the Right of Withdrawal
The right of withdrawal does not apply where an exception exists under applicable law, including for example:
goods made to the consumer’s specifications or clearly personalized;
sealed goods not suitable for return for health or hygiene reasons if unsealed after delivery;
perishable goods; or
digital content where performance has begun with the consumer’s prior express consent and acknowledgement, where applicable.
Important for Birding.Store: Some print-on-demand or special-order products may fall within one of these exceptions only where they are genuinely customized or clearly personalized under applicable law. Not every made-to-order product is automatically excluded. Product-specific return information may therefore be shown on the relevant product page.
Nothing in this section limits your legal rights in relation to faulty, damaged, or non-conforming goods.
11. Faulty, Damaged, or Incorrect Goods
If the product you receive is faulty, damaged, not as described, or incorrect, please contact us as soon as possible at info@plumasimprevistas.com with your order number and, where possible, photos of the issue.
If you are a consumer in the EU, you benefit from the legal guarantee of conformity applicable under law. This means that, for eligible goods, you may be entitled to repair, replacement, price reduction, or refund where the goods are not in conformity with the contract.
Nothing in these Terms excludes or limits any mandatory statutory consumer rights, including legal guarantee rights.
12. Environmental and Conservation Statements
Birding.Store seeks to make thoughtful product selections and to prioritize products or partners that mention lower-impact materials, more responsible production methods, or similar sustainability efforts.
However, because many products are supplied through print-on-demand providers, third-party fulfilment partners, or affiliate sellers, we do not control every material, supplier, production step, or environmental claim associated with every product.
Any general statements on the website about sustainability, conservation, or lower-impact choices should be understood in that context unless a specific product claim is expressly stated.
13. Intellectual Property
Unless otherwise stated, all content on Birding.Store, including text, design, graphics, logos, photographs, artwork, layout, and website materials, is owned by or licensed to Plumas Imprevistas Unipessoal LDA and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, sell, or otherwise use any content from this website for commercial purposes without our prior written permission.
This does not affect any rights you may have under applicable law for private, non-commercial use.
14. User Content and Reviews
If you submit a review, comment, image, or other content to Birding.Store, you confirm that:
you own the content or have the right to share it;
the content is accurate to the best of your knowledge;
the content does not infringe the rights of others; and
the content is not unlawful, abusive, misleading, defamatory, or offensive.
By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and publish that content for the purpose of operating, promoting, and improving Birding.Store and its products, unless otherwise agreed.
We reserve the right to remove user content at our discretion.

We provide these links for convenience and information. Unless expressly stated, a link does not mean that we control, endorse, or assume responsibility for the third party, its website, or its products and services.
If you leave Birding.Store and complete a purchase on a third-party website, that purchase is governed by the third party’s own terms, privacy policy, returns policy, and customer service arrangements.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, death, personal injury caused by negligence, or mandatory consumer rights.
Subject to the above, and to the maximum extent permitted by applicable law:
we are not liable for indirect or consequential losses;
we are not liable for losses caused by events outside our reasonable control;
we are not liable for third-party websites, third-party sellers, or affiliate purchases completed outside Birding.Store; and
we are not liable for minor differences in appearance that do not affect the essential conformity of the product, especially where such differences arise from screens, materials, or printing methods.
Our liability in relation to a direct order placed through Birding.Store will not exceed the total amount paid by you for the relevant order, except where the law provides otherwise.

We make reasonable efforts to keep the website available and accurate. However, we do not guarantee uninterrupted access, complete absence of errors, or that the website will always be free from technical issues.
We may suspend, withdraw, update, or change the website or parts of it at any time, including for maintenance, security, operational, or business reasons.

Your use of Birding.Store is also subject to our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect personal data and how cookies are used on the website.
Where required by law, optional cookies will only be used after your consent.
19. Force Majeure
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, civil unrest, strikes, transport disruption, internet failures, cyber incidents, pandemics, customs delays, supplier disruptions, or government action.
20. Complaints and Customer Support

If required by Portuguese law, information regarding the Livro de Reclamações Eletrónico and applicable consumer complaint mechanisms should also be made available on the website.
